대한민국 정부와 미합중국 정부는 1953년 10월 1일에 체결된 상호 방위조약의 기본정신에 입각하여,

군수협력의 강화를 통하여 양국 군사력의 합리화, 상호 운용성, 준비태세 및 효율성을 증진시킬 것을 희망하며,

상호 군수지원, 보급품 및 용역의 제공을 위한 기본 조건을 설정할 것을 희망하여,

이 상호 군수지원협정을 체결하기로 합의하였다.

제 1 조
적 용

1. 이 협정은 다음과 같은 군수지원, 보급품 및 용역의 상호 공급에 적용한다.

가. 대한민국이 위치한 군사지역내에서 양국군에 의한 경우.
대한민국이 위치한 군사지역내에서의 거래에 있어서는 동 군사지역내에 전개되어 있는 군부대의 재고로 있거나 관할 및 통제하에 있는 군수지원, 보급품 및 용역에 한하여 이 협정에 의하여 이전될 수 있다.
나. 대한민국군이 북아메리카 지역내에 주둔하거나 그곳에서 훈련 또는 교육을 수행하고 있는 동안 북아메리카에 있는 양국군에 의한경우.
북아메리카에서의 거래에 있어서는 북아메리카 지역내에 있는 군부대의 재고로 있거나 관할 및 통제하에 있는 군수지원, 보급품 및 용역에 한하여 이 협정에 의하여 이전될 수 있다.

2. 당사국은 이 협정이 (가) 대한민국 또는 미합중국 상용 보급원으로부터 합리적으로 가용하거나, (나) 무기수출통제법상의 대외군사판매 절차를 통하여 미합중국으로부터 획득할 수 있는 보급품과 용역의 일상적이고 통상적인 공급원의 확보수단으로 이용되지 않는다는 것을 양해한다. 이 협정에 의한 획득 및 이전은 대한민국과 미합중국의 법률 및 규정에 의하여 설정된 연간 예산상한선 및 이 협정에 부수되는 시행약정의 제한을 받는다. 이 협정은 주로 연합훈련, 교육, 전개, 작전 또는 기타 합동임무수행 기간중 및 예기하지 못한 상황이나 긴급사태하에서 수령국이 군수지원, 보급품 및 용역에 대한 일시적 소요 발생시, 한.미 양국간 상호 군수지원을 촉진하는데 목적이 있다. 한.미 양국의 연간 예산상한선은 실제 적대행위 기간 중에는 적용되지 않는다.

3. 주요 완성장비, 보충부품의 초도불출량, 그리고 할당 및 분배표, 편제 및 장비표 또는 이에 상응하는 문서상의 주요 편제장비의 초도발주량에 관련된 예비품은 획득 또는 이전으로부터 제외된다. 여타의 특정품목은 대한민국 및 미합중국 법률, 방침 또는 정책에 의하여 획득 및 이전으로부터 제외될 수 있다.

제 2 조
정 의

이 협정 및 구체적 절차를 규정하는 시행약정에서 사용되는 용어에는 다음의 정의가 적용된다.

가. 군수지원, 보급품 및 용역
식량, 숙영, 수송(항공수송제외), 석유, 오일, 윤활유, 피복, 통신근무, 의무근무, 탄약, 기지운용지원(부수적 건설포함), 저장근무, 시설사용, 교육훈련, 수리부속 및 구성품, 수리 및 정비근무 그리고 공항 및 항만용역

나. 시행약정
시행약정은 특정한 군수지원, 보급품 또는 용역에 관련된 보충적인 약정이며, 이는 이 협정을 더욱 명확히 정의하고 시행하기 위한 추가적 세부사항 및 조건을 설정한다.

다. 지원요청서
지원요청서는, 적절한 양식으로 권한 있는 자에 의하여 서명된 경우(하기 제 3조 제 2항 참조), 이 협정과 해당 시행약정에 따라 특정한 군수지원, 보급품 및 용역의 제공을 요청하는 문서이다.

라. 송장
송장은 이 협정과 해당 시행약정에 따라 제공된 특정한 군수지원, 보급품 및 용역에 대한 상환 또는 지불을 요청하는 제공국이 발행하는 문서이다

마. 주한미군 구성군 사령부
미 8군, 주한 미공군, 주한 미해군 사령부, 그리고 구성될 경우 주한 미해병사령부

바. 군사지역
통합군 사령관의 책임관할지역 (대한민국의 경우 미태평양사령부의 책임 관할지역)

제 3 조
기 본 조 건

1. 각 당사국은 자국 우선순위에 맞추어, 휴전 및 국가 긴급사태 또는 실제 적대행위 기간 중 상대국의 군수지원, 보급품 및 용역의 요청을 충족시킬 수 있도록 최선의 노력을 기울일 것에 합의한다.

2. 각 당사국은 당사국간의 군수지원, 보급품 및 용역의 이전이 이 협정과 해당 시행약정에 따라 발송되고 접수되는 지원요청서에 의하여 수행된다는 것에 합의한다. 지원요청서는 부속서 “가”에 규정된 경우에 한하여 시행약정없이 이 협정만을 근거로 하여 발부될 수 있다. 시행약정은 대한민국측에서는 국방부 군수국장 또는 각군에 의하여, 그리고 미합중국측에서는 사령관 또는 사령관이 지정한 자의 승인에 따라 주한미군 사령부 또는 주한미국 구성군 사령부에 의하여 협상될 수 있다. 지원의 이전이 이 협정만에 의한 지원요청서에 의하여 이루어지거나 또는 시행약정과 관련하여 이루어지거나에 관계없이, 문서들은 전체적으로 반드시 부속서 “나”의 자료 항목들을 포함하여 이전의 수행에 필요한 모든 세부사항 및 조건들을 설정하여야 한다.

3. 당사국은 표준 지원요청서 양식을 채택하도록 노력한다.
시행약정은 일반적으로 지원요청서의 발송 및 접수를 행할 권한을 부여받은 요원을 명시하여야 한다. 시행약정이 명시하고 있지 않은 경우에는, 당사국은 직접 이 협정에 의해서나 또는 시행약정에 따라 지원요청서를 발송하거나 접수할 수 있는 요원에 대한 특별한 권한이나 제한사항을 상호 통보한다. 대한민국측의 경우에는 이러한 통보사항이 대한민국 국방부 군수국 및 해당 각군에게 전달된다. 미합중국측의 경우에는 이러한 통보사항이 해당 주한 미군 구성군 사령부에 직접 전달된다.

4. 어떠한 군수지원, 보급품 및 용역의 이전에 대하여 당사국은 현금상환(현금거래) 또는 현물상환(교환거래)방식에 의한 지불에 대하여 협상을 한다. 수령국은 제공국에게 아래 제 4항 가호 또는 제 4항 나호에 따라 지불한다.

가. 현금거래
제공국은 군수지원, 보급품 또는 용역의 인도 또는 이행 후에 수령국에게 송장을 제출한다. 양 당사국은 모든 거래에 관한 기록을 유지하며 각 당사국은 당해차액을 최소한 분기 1회 지불한다. 현금거래의 가격결정에 있어서 당사국은 다음 원칙에 합의한다.
(1) 수령국을 위해 제공국의 특정획득의 경우, 가격은 동일한 품목 및 용역에 대하여 제공국의 계약자가 자국군에게 부과하는 가격보다 불리할 수 없으며, 이 협정 제 4조에 의하여 제외되는 금액을 공제하고 산정한다. 부과된 가격은 인도일정, 인도장소 및 기타 유사한 사항에 따른 차액을 고려하여 산정된다.
(2) 제공국의 자체보급원에서 이전되는 경우, 제공국은 이 협정 제 4조에 의하여 제외되는 금액을 공제하고, 지원요청서를 접수한 날짜에 동일한 군수지원, 보급 및 용역에 대하여 자국군에게 부과하는 금액과 동일한 가격을 부과한다. 가격이 설정되지 않았거나 자국군에게 부과되는 금액이 산정되지 않은 경우, 당사국은 호혜적인 가격산정 원칙에 따라 배제된 부과를 제외하고 사전에 가격을 합의한다.
(3) 각 당사국은 이러한 호혜의 원칙이 간접비(설비 및 생산장비 비용 포함), 행정 부대비용 및 계약 관리비용의 부과를 배제한다는 것에 합의한다.

나. 교환거래
양 당사국은 모든 거래에 관한 기록을 유지한다. 수령국은 제공국에 의하여 인도 또는 이행된 군수지원, 보급품 또는 용역과 동일하거나 실질상으로 동일하고 제공국을 만족시켜주는 군수지원, 보급품 또는 용역을 제공국에 이전함으로써 현물상환을 실시한다. 유사하지 않은 품목의 교환은 명백하게 금지된다. 만약 수령국이 최초 거래일로부터 1년을 초과하지 않는 범위내에서, 최초 거래시 상호 합의하거나 유효한 상환일정내에 현물상환을 실시하지 않는 경우에는 그 거래는 현금상환 거래로 간주되어, 가격이 현물상환 실시 예정일을 기준으로 산정되는 점 이외에는 위 제 4항 가호에 따라 처리된다.

5. 지원요청을 위한 확정가격이 사전에 합의되지 못하였을 경우에, 지원요청서에는 최종가격 합의시까지는 군수지원, 보급품 또는 용역제공을 요청하는 당사국이 부담하여야 할 책임액의 최대한도를 설정한다. 당사국은 최종가격을 결정하기 위하여 즉시 협상에 착수한다.

6. 송장은 해당 시행약정을, 해당 시행약정이 없는 경우에는 이 협정을 명시하며 제공기관에서 설정한 양식에 따라 작성된다. 송장에는 군수지원, 보급품 또는 용역을 제공받는 당사국의 수령증이 첨부된다.

7. 당사국은 호혜적 가격부과원칙이 준수되었으며 가격이 포기되거나 또는 배제된 비용을 포함하지 않는다는 사실을 증명하기 위하여 충분한 조달관계서류와 정보에 접할 수 있도록 상호 허용할 것에 합의한다.

8. 만약 군수지원, 보급품 또는 용역이 다른 협정의 조항에 따라 비용부과 없이 또는 보다 적은 비용부담으로 이용 가능한 경우에는 이 협정의 어떠한 규정도 군수지원, 보급품 또는 용역에 대한 비용을 증가시키는 근거로 이용되지 아니한다.

9. 군수지원, 보급품 또는 용역의 이전을 포함하는 모든 거래에 있어서 수령국은 그러한 군수지원, 보급품 또는 용역이 제공국의 사전 서면동의 없이 수령국군 이외의 타인에게 일시적으로 또는 영구적으로 어떠한 수단으로도 재이전 되지 않을 것에 동의한다.

제 4 조
가격 산정시 제외되는 부과

수령국에 의하여 물자, 용역, 보급품 및 장비의 획득에 적용될 수 있는 조세 및 관세감면 협정의 규정은 이 협정에 따라 이전되는 군수지원, 보급품 및 용역에 적용된다. 당사국은 조세감면을 극대화하기 위하여 적절한 문서를 제공하는데 협력한다. 수령국이 통상 면제해 주는 조세 또는 관세가 제공국에 의하여 이미 지불되어 환불받을 수 없는 경우에는 제공국은 거래에 합의하기 이전에 수령국에 통보한다. 그러한 경우 수령국은 가능한 한 보급품에 대한 현금거래를 교환거래로 바꿀 수 있다. 현물상환이 불가능한 경우 수령국이 지불할 대금은 제공국에 의한 회복이 불능인 조세 또는 관세만을 포함한다.

제 5 조
해석 및 개정

1. 각 당사국은 이 협정의 해석 또는 적용에 관한 당사국간의 견해차이를 해소하기 위하여 성실히 노력할 것에 합의한다. 어느 한 시행약정 또는 거래에 있어서 당사국은 시행약정 또는 거래의 해석 또는 적용에 관한 견해차이를 해소하기 위하여 성실히 노력한다. 분쟁해결은 협상에 의하며 해결을 위하여 국제재판소나 제 3국에 회부되지 아니한다.

2. 일방 당사국은 언제든지 90일 이전에 상대국에 사전 통고함으로써 이 협정의 수정을 요청할 수 있다. 이러한 요청이 있을 경우 양 당사국은 즉시 협상에 착수한다.

제 6 조
발효일 및 종료

이 협상은 양 당사국이 모두 서명한 날로부터 발효되며 일방 당사국이 최소한 180일 이전에 서면으로 상대국에게 통보함으로써 종료될 때까지 효력을 가진다.

1988년 6월 8일 서울에서 동등히 정본인 한국어 및 영어본으로 각 2부씩 작성하였다.

MUTUAL LOGISTIC SUPPORT AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA

PREAMBLE

The Government of the Republic of Korea (R.O.K) and the Government of the United States (U.S.) of America, under the purview of the basic spirit of the Mutual Defense Treaty of October 1, 1953.

Desiring to further the rationalization, interoperability, readiness, and effectiveness of their respective military forces through increased logistics cooperation, and

Desiring to establish basic terms and conditions for provision of mutual logistic support, supplies, and services,

Have resolved to conclude this mutual logistic support agreement.

ARTICLE Ⅰ
Applicability

1. This Agreement applies to reciprocal provision of logistic support, supplies, and services:
a. By the military forces of the two nations in the military region in which the R.O.K. is located. For transactions in the military region in which the R.O.K. is located, only logistic support, supplies, and services in the inventory, or otherwise under the jurisdiction and control, of forces deployed in the military region may be transferred this Agreement.
b. By the military forces of the two nations in North America while forces of the R.O.K. are stationed in North America or performing exercises or training therein. For transactions in North America, only logistic support, supplies, and services in the inventory, or otherwise under the jurisdiction and control, of forces in North America may be transferred under this Agreement.

2. The parties understand that this Agreement will not be employed in a manner to serve as a routine and normal source for supplies and services: (a) reasonably available from R.O.K. or U.S. commercial sources; or the acquirable from the U.S. through Foreign Military Sales procedures under the Arms Export Control Act. Acquisition and transfers under this Agreement are subject to annual dollar limitations established by R.O.K. and U.S. law and regulation, and to implementing arrangements incident to this Agreement. The Agreement is designed to facilitate mutual logistic support between the R.O.K and the U.S. to be used primarily during combined exercises, training, deployments, operations, or other cooperative efforts, and for unforeseen circumstances or exigencies in which the recipient may have a temporary need of logistic support, supplies, and services. Annual R.O.K. and U.S. monetary limitations do not apply during periods of active hostilities.

3. Excluded from acquisition or transfer are major end items of equipment, initial quantities of replacement parts, and spares associated with the initial order quantity of major items of organizational equipment covered in tables of allowances and distribution, tables of organization and equipment, or equivalent documents. Other specific items may be excluded from acquisition or transfer by R.O.K. or U.S. law, directive, or policy.

ARTICLE Ⅱ
Definitions

As used in this Agreement and in any implementing arrangements which provide specific procedures, the following definitions apply:
a. Logistic Support, Supplies, and Services.
Food, billeting, transportation (except airlift), petroleum, oils, lubricants, clothing, communication services, medical services, ammunitions, base operations support and construction incident thereto, storage services, use of facilities, training services, spare parts and components, repair and maintenance services, and airport and seaport services.
b. Implementing Arrangement.
An implementing arrangement is a supplementary arrangement related to specific logistic support, supplies, or services, which sets forth the additional details, terms, and conditions to further define and carry out this Agreement.
c. Order.
An order, when in its proper form and signed by an authorized official (see Article Ⅲ, paragraph 2 below), is a request for the provision of specific logistic support, supplies, or services pursuant to this Agreement and applicable implementing arrangement(s), if any.
d. Invoice.
An invoice is a document from the supplying party which requests reimbursement or payment for specific logistic support, supplies, or services rendered pursuant to this Agreement and applicable implementing arrangement(s), if any.
e. United States Forces, Korea (USFK) Component Commands.
Eighth United States Army (EUSA); United States Air Forces, Korea (USAFK); and United States Naval Forces, Korea (USNFK). Additionally, United States Marine Forces Korea (USMARFORK) when established.
f. Military Region.
The geographical area of responsibility assigned to the commander of a unified combatant command. (For the R.O.K., this is the U.S. Pacific Command geographic area of responsibility.)

ARTICLE Ⅲ
Basic Terms and Conditions

I. Each party to utilize its best endeavors, consistent with priorities, to satisfy requests of the other party for logistic support, supplies, and services, during the period of the Armistice and during periods of national emergency or active hostilities.

2. Each party agreesthat thetransfer oflogistic support, supplies, andservices the parties shall be accomplished by orders issued and accepted under this Agreement and any applicable implementing arrangement. Orders may be issued under this Agreement alone without an implementing arrangement only in those cases set forth in Annex A. Implementing arrangements may be negotiated on the part of the R.O.K. by either the Director, Logistics Bureau, Ministry of National Defense (MND), or individual R.O.K. military services, and on the part of the U.S. by either USFK or a USFK Component Command as authorized by the Commander or designee. Whether the transfer is accomplished by orders under this Agreement alone or in conjunction with an implementing arrangement, the documents taken together must set forth all necessary details, terms, and conditions to carry out the transfer, including the data elements in Annex B.

3. The parties will endeavor to adopt a standard order forms. An implementing arrangement will generally identify those personnel authorized to issue and accept orders. The parties will notify each other of specific authorizations or limitation on those personnel able to issue or accept orders directly under this Agreement or under an implementing arrangement, when the implementing arrangement does not state this information. In the case of the R.O.K., these notifications will go to the proper Services, as well as to the Logistics Bureau, MND. ln the case of the U.S., these notifications will go directly to the USFK Component Command concerned,

4. For any transfer of logistic support, supplies, or services, the parties may negotiate for payment either in cash (a “reimbursable transaction”) or replacement in kind (an “exchange transaction”). The receiving party will pay the supplying party in accordance with either paragraph 4a or 4b below.
a. Reimbursable Transaction.
The supplying party will submit invoices to the receiving party after delivery or performance of the logistic support, supplies, or services. Both parties will maintain records of all transactions, and each party will pay outstanding balances not less frequently than quarterly. In pricing a reimbursable transaction, the parties agree to the following principles:
(1) In the case of specific acquisition by the supplying party for a receiving party, the price will be no less favorable than the price charged the armed forces by the contractor of the supplying party for identical items or service, less any amounts excluded by Article Ⅳ of this Agreement. The price charged may take into account differentials due to delivery schedules, points of delivery, and other similar considerations.
(2) In the case of transfer from the supplying party’s own resources, the supplying party will charge the same price it charges its own forces for identical logistic support, supplies, or services as of the date the order is accepted, less any amounts excluded by Article Ⅳ of this Agreement. In any case where a price has not been established or charges are not made for one’s own forces, the parties will agree on a price in advance, excluding charges that are precluded under the reciprocal pricing principles.
(3) Each party agrees that these reciprocal principles preclude the charging of indirect costs (including charges for plant and production equipment), administration surcharges, and contract administration cost.
b. Exchange Transaction.
Both parties will maintain records of all transactions. The receiving party will repay-in-kind by transferring logistic support, supplies, or services that are satisfactory to supplying party and which are identical, or substantially identical, to the logistic support, supplies, or services delivered or performed by the supplying party. Exchanging dissimilar items is expressly prohibited. If the receiving party does not pay in kind within the terms of a replacement schedule agreed to or in effect at time of the original transaction, with timeframes which may not exceed one (1) year from the date of the original transaction, the transaction shall be deemed reimbursable and governed by paragraph 4a above, except that the price will be established based upon the date the payment in kind was to have taken place.

5. When a definite price for the order is not agreed upon in advance, the order, pending agreement on final price, will set forth a maximum limitation of liability for the party ordering the logistic support, supplies, or services. The parties will then promptly enter into negotiation to establish the final price.

6. The invoice will contain and identification of the applicable implementing arrangement or, in the absence thereof, this Agreement, and will be in the format set forth by the supplying organization. The invoice will be accompanied by evidence of receipt by the party receiving the logistic support, supplies, or services.

7. The parties agree to grant each other access to procurement documentation and information sufficient to verity, when applicable, that reciprocal pricing principles have been followed and prices do not include waived or excluded costs.

8. No term in this Agreement shall serve as a basis for an increased charge for logistic support, supplies, or services, if such logistic support, supplies, or services would be available without charge, or for a lesser charge, under the terms of another agreement.

9. In all transactions involving the transfer of logistic support, supplies, or services, the receiving party agrees that such logistic support, supplies, or services will not be retransferred, either temporarily or permanently, by any means to other than the forces of the receiving party without prior written consent of the supplying party.

ARTICLE Ⅳ
Excluded Charges for Price Determination

Provisions of tax and customs relief agreements applicable to the acquisition of materials, services, supplies, and equipment by the receiving party will apply to logistic support, supplies, and services transferred under this Agreement. The panties will cooperate to provide proper documentation to maximize tax relief. In the case where taxes or customs duties for which a receiving party would ordinarily have an exemption have already been paid by the supplying party and cannot be recovered, the supplying party will advise the receiving party prior to agreeing to the transaction. In such a case the receiving party may, if practicable, replace the supplies as and exchange transaction in lieu of reimbursement for the supplies. If replacement in kind is not practicable, the price paid by the receiving party will include only those taxes or customs duties not recoverable by the supplying party.

ARTICLE Ⅴ
Interpretation and Revision

1. Each party agrees to make a good faith effort to resolve disagreements between the parties with respect to the interpretation or application of this Agreement. In the case of an implementing arrangement or transaction, the parties will make a good faith effort to resolve any disagreements with respect to interpretation or application of the arrangement or transaction. Resolution will be by negotiation and will not be referred to an international tribunal or third party for settlement.

2. Either party may, at any time, request revision of this Agreement by giving the other party 90 days notice. In the event such a request is made, the two parties shall promptly enter into negotiations.

ARTICLE Ⅵ
Effective Date and Termination

This Agreement will become effective on the date of the last signature and will continue in effect until terminated by either party giving not less than 180 days notice in writing to the other party.

Done at Seoul on 8 June 1988 in two (2) originals in the Korean language, and two (2) originals in the English language, all texts being equally authentic.

ANNEX A

Pursuant to Article Ⅲ, paragraph 2, orders or requisitions may be issued under this Agreement alone in the following circumstances:
